Understanding how the federal system works is the first step to protecting yourself.<\/p>\n<h2>State court vs. federal court \u2014 why it matters<\/h2>\n<p>Most criminal cases in Texas are <strong>state<\/strong> cases, prosecuted by a county or district attorney under the Texas Penal Code in a local courthouse. A case becomes <strong>federal<\/strong> when it involves an alleged violation of federal law \u2014 for example, conduct that crosses state lines or the U.S.\u2013Mexico border, occurs on federal property, or falls under federal statutes covering drugs, immigration, firearms, or fraud. In the Valley, federal cases are handled by the <strong>U.S. District Court for the Southern District of Texas<\/strong>, with courthouses in McAllen and Brownsville, and are prosecuted by an Assistant U.S. Attorney rather than the local DA.<\/p>\n<h2>Federal cases are usually built quietly, over time<\/h2>\n<p>Unlike many state arrests that follow a single incident, federal cases are often investigated for months \u2014 sometimes years \u2014 before anyone is charged. Agencies such as the DEA, FBI, Homeland Security Investigations (HSI), and ATF gather evidence, and the U.S. Attorney presents it to a <strong>grand jury<\/strong>. If the grand jury finds probable cause, it returns an <strong>indictment<\/strong>, the formal charging document. (Some cases begin with a criminal complaint and an arrest first, with an indictment following.) By the time charges become public, the government has often prepared extensively \u2014 one reason it helps to have counsel as early as possible, even during an investigation.<\/p>\n<h2>What happens right after a federal arrest<\/h2>\n<p>The first court date is usually the <strong>initial appearance<\/strong>, where a magistrate judge explains the charges and your rights, including the right to a lawyer. Two things follow closely:<\/p>\n<ul>\n<li><strong>Arraignment<\/strong> \u2014 the charges are formally read and you enter a plea.<\/li>\n<li><strong>Detention hearing<\/strong> \u2014 the judge decides whether you are released or held until trial.<\/li>\n<\/ul>\n<p>Release in the federal system is <strong>not automatic<\/strong>. Under the federal <strong>Bail Reform Act<\/strong>, the judge weighs whether any conditions would reasonably assure your appearance in court and the safety of the community. For certain charges, the law even begins with a presumption in favor of detention \u2014 which the defense can address. That is why the detention hearing is one of the most important early moments in a federal case.<\/p>\n<h2>Key differences that raise the stakes<\/h2>\n<ul>\n<li><strong>Grand jury indictment.<\/strong> Federal felonies generally must be charged by a grand jury, whose proceedings are secret and where the accused has no right to appear.<\/li>\n<li><strong>Sentencing Guidelines.<\/strong> Federal sentences are shaped by the detailed, point-based U.S. Sentencing Guidelines, along with mandatory minimums for some offenses.<\/li>\n<li><strong>No parole.<\/strong> The federal system abolished parole, so a federal sentence is served almost in full. That makes every decision along the way consequential.<\/li>\n<li><strong>Significant resources.<\/strong> Federal prosecutors work alongside federal agencies with substantial resources, and cases are often complex and document-heavy.<\/li>\n<\/ul>\n<div class=\"callout\"><p>If you learn you are the <strong>target<\/strong> of a federal investigation \u2014 or agents ask to &ldquo;just talk&rdquo; \u2014 remember you have the right to remain silent and the right to a lawyer. What you say can be used to build the case.
